Terms of Service

1. Acceptance of Terms

By accessing or using Atomic Works · Invoices ("Atomic Works," "the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including free and paid accounts. They apply together with our Privacy Policy.

2. Description of Service

Atomic Works is a web-based invoicing and business management platform for freelancers and small businesses. Features include invoice creation, client management, payment tracking, AI-assisted invoice generation, automated payment reminders, expense line items on invoices, and analytics. Feature availability varies by subscription tier. The Service is under active development and features may change over time.

We are software only — not your accountant, lawyer, tax advisor, or collection agency. You are solely responsible for the accuracy, legality, and tax treatment of every invoice and email you send.

3. Account Registration

You must be at least 18 years old to use the Service. You sign in with Google OAuth and are responsible for maintaining the security of your Google account. You agree to provide accurate information and keep it updated. Each account is for a single user — account sharing is not permitted.

4. Subscription Plans and Billing

Atomic Works offers a free Starter plan and a paid Pro plan at $12/month (monthly billing) or $99/year (annual billing). Prices are in USD and subject to applicable taxes. Free trials may apply before billing begins (7 days — as shown at checkout).

The free plan includes unlimited clients, unlimited invoices, PDF download, manual email send, and full invoice history. Pro unlocks online payment links, analytics, AI features, follow-ups, and branding options.

Billing is handled by Stripe. By subscribing, you authorize Stripe to charge your payment method on a recurring basis. Subscriptions renew automatically unless cancelled before the renewal date. We do not charge a platform fee on invoice payments you collect from clients; Pro subscription fees are separate from Stripe processing fees.

5. Refund Policy

Unless required by law, refunds follow this policy when you downgrade or cancel Pro:

• Monthly → Free, within 7 days of your current billing period start: immediate cancellation with a prorated refund based on a 30-day cycle.
• Monthly → Free, after 7 days: cancellation at the end of the current billing period; no refund for the current period.
• Annual → Free or Monthly, within 30 days of your annual period start: full annual refund if you have already been charged; no refund if you are still in a free trial.
• Annual → Free or Monthly, after 30 days: refund equal to $99 minus ($12 × number of billable months since the annual period started), counting each calendar month in full, including the current month.

Refund amounts shown in the app are estimates. Final amounts are processed through Stripe and may take several business days to appear. EU users retain any statutory 14-day right of withdrawal where applicable, regardless of the policy above.

6. Cancellation

You may cancel or change your subscription from the Upgrade or Settings page. Cancellation of Pro stops future subscription charges; it does not delete your account. You should cancel Pro before deleting your account to avoid further charges. You may export your data from Settings before deleting your account. When you delete your account, we permanently remove app data linked to your account, as described in our Privacy Policy.

7. Acceptable Use

You agree not to use the Service to:

• Send fraudulent, misleading, or illegal invoices
• Violate any applicable law or regulation
• Attempt to gain unauthorized access to the Service or other accounts
• Use the Service for spam, phishing, or harassment
• Reverse engineer, copy, or redistribute the Service
• Use automated scripts to scrape or abuse the Service
• Bypass plan limits or entitlements

We reserve the right to suspend or terminate accounts that violate these terms, with or without refund where permitted by law.

8. Payment Processing

Online invoice payments are processed by Stripe on your connected Stripe account (Stripe Connect). Atomic Works does not store credit card numbers or bank account details for client payments. We are not the merchant of record for your client invoice payments. Stripe's processing fees (approximately 2.9% + $0.30 for cards, 0.8% for ACH bank transfers) apply as disclosed by Stripe. Atomic Works charges no additional percentage on invoice transactions.

Public invoice links allow anyone with the link to view invoice details. Treat links as confidential.

9. AI Features

Atomic Works uses the Anthropic Claude API to power AI features including invoice creation from plain text and automated follow-up email drafting. AI-generated content is provided as a draft for your review. You authorize us to send email on your behalf, including follow-ups you approve or enable for automatic sending. You are responsible for reviewing all AI-generated invoices and emails before sending. Atomic Works makes no warranty regarding the accuracy of AI-generated content.

10. Your Data

You own your data. Atomic Works does not sell your data to third parties. Invoice data, client information, and business records you create remain yours. We use your data solely to provide and improve the Service. See our Privacy Policy for full details.

11. Intellectual Property

The Atomic Works platform, including its design, code, and branding, is owned by Atomic Works. Your invoice content, client data, and business records are owned by you. You grant Atomic Works a limited license to store and process your data solely to provide the Service.

12. Limitation of Liability

Atomic Works is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to lost revenue, missed payments, or data loss. Our total liability to you shall not exceed the greater of the amount you paid us in the 12 months preceding the claim or one hundred U.S. dollars ($100), except where prohibited by law.

13. Service Availability

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience downtime. We will provide reasonable advance notice of planned maintenance where possible.

14. Changes to Terms

We may update these terms from time to time. We will notify you of material changes by email or by displaying a notice in the app at least 14 days before changes take effect, where required. Continued use of the Service after changes constitutes acceptance of the new terms.

15. Governing Law

These terms are governed by the laws of the State of New York, United States. Any disputes shall be resolved in the courts of New York County, New York, except where prohibited by applicable consumer protection law in your jurisdiction.
